Description:

Many remediated sites live on long after the issuance of the Response Action Outcome (RAO). The New Jersey Department of Environmental Protection (NJDEP) requires responsible parties to submit post-RAO Biennial Certifications. These certifications ensure the protectiveness of the remedy, involving engineering controls (i.e., cap) and/or institutional controls (i.e., deed notice).  

This program will delve into the comprehensive filing requirements for the NJDEP’s Biennial Certification. Topics of discussion include addressing emerging contaminants like PFAS, as well as the associated legal and regulatory considerations, such as RAO’s re-openers, impacts on property transactions, access issues, and NJDEP enforcement measures.  Join us for an exploration of these crucial facets.
 
The presentation will be followed by a moderated interactive open forum roundtable discussion. Please come prepared to discuss critical issues or concerns you feel directly impact your work.
