Positive Outcomes from NJDEP’s RPII Meeting with Stakeholders – A Big Win for LSRPs

NJDEP’s Contaminated Site Remediation & Redevelopment (CSRR) group met with Stakeholders on November 2, 2023, to discuss next steps in the Remediation Process Improvement Initiative (RPII). We are pleased to share that there is a new Remedial Action Permit (RAP) Application Backlog Strategy which will be launching soon.

LSRPs will have the option to complete a new certification for Initial RAP Applications which will result in CSRR issuing the permit. The soil certification will be developed first and will be followed by a groundwater certification. NJDEP shared examples of draft language for the certifications at the meeting. For RAP applications already submitted, the NJDEP will email the PRCR and LSRP providing an option to submit the certification.

CSRR will audit a percentage of the issued RAPs as part of the biennial certification process.

The LSRP retains the option not to complete the new certification, in which case CSRR will conduct an inspection of the application and make a determination as to whether or not additional review is necessary. It is anticipated the program will begin to become active by the end of the year.
