Course Description:

Conducting effective due diligence is a vital part of any property transaction in assessing environmental risk and liabilities. Environmental professionals, attorneys, engineers, real estate professionals and developers must use the highest standard of care and responsibility when preforming and assessing due diligence, especially as hidden environmental obligations can be costly to all parties involved, and since due diligence continues to evolve.

The new Phase I Standard (ASTM E1527-21) was recently published and is under consideration for adoption by the USEPA. In New Jersey, a potential purchaser must conduct a Preliminary Assessment (N.J.A.C. 7:26E-3.1 and 3.2) as appropriate inquiry. We are here to help you demystify the process!

This updated and streamlined 4-hour course will explore the environmental risks and liabilities associated with real estate transactions and how performing environmental due diligence can help mitigate them. Additionally, we’ll also identify the applicable laws, regulations, standards, and guidance documents governing due diligence, and we will use the new 2021 ASTM standard practice components.

Attendees of this course will receive:

  • An overview of the types and components of environmental due diligence and when they should be performed.
  • A review of the two primary types of environmental assessments in New Jersey, the ASTM Phase Environmental Site Assessment (Phase I ESA) and the Preliminary Assessment (PA), and what they include, what they don't, the protections they offer, and when they should be performed.
  • An understanding of the role and legal liability of Licensed Site Remediation Professionals.
  • Knowledge of due diligence-related legal nuances that are commonly encountered during real estate transactions.
  • Experience gained from numerous case studies used for illustration purposes.
